(AP) — A New York man who allegedly tried to buy Viagra for a client, when in fact he was selling the drug to a friend in India, has been found to be mentally unavailable.
David Ayd, 42, was found guilty of conspiracy to traffic in counterfeit goods and of attempting to sell or supply counterfeit goods and possession of counterfeit goods with intent to distribute. He is scheduled to be sentenced in Brooklyn County Superior Court on Sept. 17.
“It’s a very serious thing,” said Dr. David B. Kratz, a psychiatrist at New York University Brooklyn Hospital.
Kratz said the patient was taking Viagra from a pharmacy in New York, but that he had been taking it in the United States for about two years.
“He was selling the drug to a friend in India and he was actually taking it for a while and when he took the drug he was not taking it at all,” Kratz said.
When Kratz was interviewed by The New York Times, he claimed he sold the drug in the United States to other people and that he had no idea they had it. He said he was told the drug was “very dangerous and not available to anyone.”
Kratz said he had no idea who was buying the drug or selling it to other people, and was unaware that the drug he was purchasing was counterfeit.
When the Times asked Kratz if he could help the case, he said he would. The FDA approved the drug in late March and the FDA released a final advisory panel in June saying Kratz’s case is a “significant security risk.”
Kratz’s lawyer said his client is in the United States for the first time since he became a patient in 1998.
“This is a serious matter that requires immediate attention,” said Kratz, who is seeking compensation for his legal expenses.
Kratz and his partner, John Smith, filed a motion for a new trial in September, arguing that the jury improperly influenced the verdict.
Kratz said the verdict in his case is “extremely uncertain” and “will probably be upheld.”
“This case is not a secure situation, and this is not a legal battle,” he said.
Kratz said he believes his client is mentally ill and “is a danger to others.”
The trial is set for Oct. 8.
